Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and MorealAI (“MorealAI”, “we”, “us” or “our”) and govern your access to and use of our website, desktop application, APIs and related services (together, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You are responsible for the information you provide, for keeping your credentials confidential, and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable license to access and use the Service for your personal or internal business purposes. We reserve all rights not expressly granted.

To keep MorealAI safe and welcoming for everyone, you agree not to:

• Use the Service to create or share content that is illegal, harmful, hateful, harassing or that infringes the rights of others.
• Generate sexual content involving minors, non-consensual intimate imagery, or deceptive impersonation of real people.
• Attempt to reverse engineer, scrape, overload, or interfere with the Service or its security.
• Use the Service to develop a competing model by improperly extracting outputs at scale.
• Misrepresent AI-generated content as human-made where doing so is deceptive or unlawful.
• Violate any applicable law or the rights of any third party.

“User Content” means the prompts, files and other materials you submit to the Service. You retain ownership of your User Content. You grant us a worldwide, non-exclusive license to host, process and display it solely to operate and improve the Service.

You represent that you have the rights necessary to submit your User Content and that it does not violate these Terms or any law.

Subject to your compliance with these Terms, and to the extent permitted by law, we assign to you our rights in the output generated for you. Outputs may not be unique; similar content may be generated for other users. You are responsible for reviewing outputs before relying on or publishing them.

Some features require a paid plan. Fees, billing cycles and features are described at the point of purchase. Unless stated otherwise, subscriptions renew automatically until cancelled, and payments are non-refundable except where required by law.

The Service, including its software, models, design, logos and trademarks, is owned by MorealAI or its licensors and is protected by intellectual-property laws. Except for the limited license granted to you, nothing in these Terms transfers any of these rights to you.

The Service may link to or integrate with third-party products. We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that outputs will be accurate or suitable for your purposes.

To the maximum extent permitted by law, MorealAI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

You agree to indemnify and hold harmless MorealAI and its affiliates from any claims, damages and expenses arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws applicable in the jurisdiction in which MorealAI is established, without regard to conflict-of-laws principles. Courts located there will have exclusive jurisdiction, except where mandatory local law provides otherwise.

We may update these Terms from time to time. When changes are material, we will update the “Last updated” date and provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
